Terms of application
1. Introduction
This regulation (hereinafter as: the Regulation; or the Contract) is a legally binding agreement between Hu-Mago Kft. (6050 Lajosmizse, Elkerülő út 3.; hereinafter as: the Operator), as the operator of the websites and services available under domain names
bevasarlokocsi.eu and
shopping-trolley.eu, and the user of the Service (hereinafter as: the User), which shall be observed by both Parties. The registration to the Service shall be subject to being aware of and approving the Regulation. The application of the Service by Users who have not registered shall be deemed as approval of this Regulation.
The Operator reserves the right to modify this Regulation without a separate notice or providing reasons, even with a retroactive effect. It is the User’s liability to follow the Regulation’s amendments with attention. Upon such modification the application of the Service shall be qualified as approval of the amendment of the Regulation.
2. Registration
Subject to the restrictions of this Regulation, any person may be a registered user of the Service who understands, accepts and observes this Regulation, the applicable law and the Netikett. Without registration, the Users may only read the public pages of the Service but may not use for example the interactive services.
The Operator reserves the right to restrict or refuse the access of any User registering with false data to the Service. In case of any change in the data required for registration, the User shall enter such change in his account. The User shall take exclusive responsibility for preserving the privacy of the user passwords and accounts. Furthermore, each User shall entirely be responsible for any activity performed in connection with their accounts. The Users are obliged to immediately inform the Operator about any unauthorised use of their account or any action violating security. The Operator shall take no responsibility for the damages arising from any unauthorised use of the user passwords or accounts, whether with or without knowledge of the Users. Nevertheless, the User shall be liable for any damages causing to the Operator or any third party with the unauthorised use of his own user password or account.
3. The Operator’s rights attached to intellectual products and the protection of industrial law
Any content published by the Operator within the frames of the Service as well as the Service (including without limitation all articles, photographs, graphics and other materials accessible under the Service, the design and editing principle of the Service, the software and other solutions, ideas and applications realised during the operation of the Service) shall constitute the Operator’s intellectual property and, beyond reading, posting it in relation to the intended use of the Service, and the required temporary reproduction, and the hard-disk saving or printing it for personal, non-commercial purpose, such content and the Service may not be used or utilised in any other form unless with the Operator’s preliminary written consent. The domains
bevasarlokocsi.eu and
shopping-trolley.eu are domain names registered in favour of the Operator. These names, including deceptively similar names and terms, may only be used with the
Operator’s prior written consent, except for references to the name of the Service.
4. Content made accessible by the Operator within the scope of the Service
The content made accessible within the scope of the Service shall only serve informative purposes. The Operator shall assume no liability for the accuracy, reliability, entireness, appropriateness of the content (including the software applied during the operation of the Service, too), or any direct or indirect damages arising form the lack thereof – owing to the impossibility of the regular and continuous control of the high number of sources used by the Operator.
5. Advertisements and other pages accessible from the pages of the Service
The Service also includes links leading to websites operated by third parties. Should the Operator realises that any site linked by it or any linking infringes third parties’ rights or the effective legal provisions, the link shall be removed without delay. Furthermore, the Operator assumes no liability for the content of the links applied by it or of the websites called down by them.
The Operator takes no responsibility for the content of the advertisement published on the pages of the Service, and the sponsored political advertisement posted there do not reflect the opinion of the editorial staff or the Operator.
6. Rules related to the use of the interactive parts of the Service
The interactive services available under the Service (e.g. interactive text boxes; company and product profiles) are public and may be used by any person without compensation. The created contents may be supervised by moderators appointed by the Operator; the purpose of moderation is to ensure a civilised tone and the smooth operation of the Service. The moderators are entitled to delete passages of the content, suspend or delete users, too. The Operator assumes no responsibility for any damages or inconveniences arising from the insufficiency of moderation. During their work, moderators shall act not as a legal forum and not necessarily on the basis of legal considerations. However, if finding any comment or content that supposedly violates the law, moderators have the right to remove such comment or content without a separate notice. The moderators may act against nick-counterfeiting, topic destruction and any tone, conduct or behaviour unacceptable in the moderators’ opinion, too.
Any content published by the Users, including any material or immaterial damages caused by the content or otherwise arisen in connection with it shall be the exclusive responsibility of the given User. Consequently, such User is obliged to guarantee that the content published by him (for instance, personal or particular data of third parties, comments, pictures, intellectual products under copyright or legal custody) shall not violate third parties’ rights or the legal provisions neither directly nor indirectly (for instance, by exhorting them to commit crimes).
As for the websites
bevasarlokocsi.eu and
shopping-trolley.eu, any own content may only be posted upon approval of the Terms of Application. The creation and posting of own contents is free of charge.
The Operator has the right to handle and archive the relevant personal and other user’s rights produced within the scope determined in accordance with Act 100/2003 on electronic communication and EKT.
The Operator is entitled to delete or modify any content contradicting the applicable law or this Regulation. In case of breach of law, the Operator shall cooperate with the competent authorities in accordance with the effective legal provisions and furnishes them with the available data on the User breaching the law. As a further sanction of the breach of law or the breach of this Regulation, the Operator may exclude the guilty User from the Service for a particular period or definitively.
The Operator reserves the right to terminate any part of the Service without a prior notice.
7. Other provisions
The language of the contracts to be concluded by using the website is Hungarian (or English). The contracts entered into in this manner shall not comprise a written contract and therefore shall not be filed by the Operator.
The Agreement entered into between the Operator and the User based upon this Regulation shall terminate in the following cases:
(a) if the User asks for the deletion of its registration;
(b) if the User is ultimately banned from the Service, namely, its access is finally terminated;
(d) upon the User’s death;
(e) upon the termination of the Service; and
(f) after the Regulation becomes effective.
Should any provision of this Regulation prove to be invalid or unenforceable, it shall be replaced by a provision that exerts an economic effect approximating the purpose of the invalid or unenforceable provision to the largest extent possible.
This Contract shall be subject to the legislation of the Republic of Hungary. For judgement of any legal disputes arising with this Contract, the Users and the Operator shall be subject to the exclusive competence of the Central District Court or, depending upon jurisdiction, the Metropolitan Court of Budapest.
The Operator reserves the right to terminate any part of the Service, the content of the pages without a separate notice.
